1. LEGAL NOTICE
These General Conditions of Use (hereinafter the "GCU") are offered by Elips (hereinafter the "Company"), a EURL with capital of 1,000 euros, registered in the Annecy Trade and Companies Register under number 931 377 832, whose registered office is located at 320 rue des Sorbiers 74300 Thyez. Its toll-free telephone number is 06 10 72 93 21, its e-mail address is contact@elips3d.com and its individual VAT identification number is FR08 931 377 832.
The company is the owner and publisher of the https://elips-3d.com/ website (hereinafter the "Site"). The Site is hosted by OVH, which can be reached at https://help.ovhcloud.com/fr/ .
The Site's publication director is Pascal Tomasina.
2. CONDITIONS OF ACCESS AND USE
Before using the Site, the user of the Site is requested to read carefully the present GTU describing the rules applicable to the use of the Site. By accessing the Site, the user agrees to be bound by these GTU and all its provisions.
The user acknowledges that the Site may only be used for his personal needs or for the internal needs of his company and that he is not authorized to make the Site, in whole or in part, available to third parties, in particular for commercial purposes.
If the user does not agree with one or more of the provisions of these GCU, he/she is requested not to use the Site.

The Company endeavours to ensure uninterrupted access to the Site, but cannot be held liable in the event of impossibility of access to the Site due to constraints inherent in the operation of the Internet or any other event beyond its reasonable control.

All data, information and content accessible from the Site are provided for information and/or demonstration purposes. The Company cannot guarantee the accuracy and completeness of the data, information and content provided to the user when using the Site.
Nor can the Company guarantee perfect consistency between the offers published on the Site and those available in its physical premises.
The user remains entirely responsible for preserving the security and integrity of its data, hardware and software when accessing or using the Site.
The Company may not be held liable for any computer virus, bug, intervention or unauthorized external intrusion on the computer system, fraud, technical failure or any other reason beyond the Company's control.
5. INTELLECTUAL PROPERTY
The Company owns or is authorized to use all intellectual property rights (such as copyright, neighboring rights, trademark rights, database producers' rights) relating to both the structure and content (such as images, sounds, videos, photographs, logos, trademarks, graphic elements, tools, software, documents and all other data) of the Site.
Any reproduction (including downloading, printing, etc.), representation, adaptation, modification, extraction, translation, transformation, distribution, integration into another site, commercial or non-commercial exploitation and/or reuse in any way whatsoever of all or part of the Site is strictly prohibited without the express written consent of the Company. 8. AMENDMENTS TO THE GGU
The Company may modify these GCU at any time and without notice. The user should therefore read and check these GTU each time he/she uses the Site. Use of the Site after consultation of the new GTUs implies acceptance by the user of the modifications made to the GTUs.

The Company reserves the right to request proof of identity in order to verify the authenticity of a claim.
10. MISCELLANEOUS PROVISIONS
These GCU constitute the entire agreement between the User and the Company with respect to its subject matter.
If one or more provisions of these GCU are declared invalid or inapplicable, the other clauses will retain their full force and scope.
These GCU are governed by French law and fall under the exclusive jurisdiction of the French courts.
General Terms and Conditions (GTC)- Location

1. Purpose of the General Terms and Conditions
The purpose of the General Terms and Conditions of Sale is to govern all sales concluded between Elips and any professional customer (hereinafter referred to as the "Customer"), through the website https://elips-3d.com/. The placing of any order by the Customer implies acceptance of these General Terms and Conditions of Sale. The Customer declares that he/she has read the General Terms and Conditions of Sale and accepts them in their entirety.
2. DEFINITIONS
Headset rental: This corresponds to the rental of virtual reality equipment delivered and collected from the customer at a specific date and time.
3. CONTENTS OF A RENTAL
3.1 . VR HELMET rental
Helmet rentals correspond to a 10-day rental of an autonomous, easy-to-use virtual reality station belonging to Elips, starting from delivery to the customer. The helmets are used autonomously, in comfortable conditions (inside your home, with the necessary space provided: 4m2 per helmet), and can be used by as many people as the customer wishes.
3.2 . Deposit for RV HELMET rental
Helmet rentals are subject to a €200 deposit, which is not debited from the customer's bank account and is managed by Stripe, whose website is http://www.stripe.com. This deposit is there to make the customer aware of his responsibility in the event of theft or damage to the equipment. This deposit is manually released by the administrator of the https://elips-3d.com/ website if the equipment is returned in perfect condition; it is totally or partially debited from the customer's bank account in the event of a dispute.
4. REPAYMENT CONDITION
It is not possible to claim a total or partial refund of a rental outside the provisions of the Commercial Code at the time of purchase. All requests for refunds must be made by e-mail by sending the request to contact@elips3d.com .
5. PRICE
The applicable prices include all taxes, are expressed in euros and are those in force on the day of purchase of a rental. Elips reserves the right to modify its prices. The applicable prices are those presented on the website at the time of the order.
6. INSURANCE
Elips is insured by MMA Assurances for damage directly linked to its activity and involving its civil liability.
7. DATA PROCESSING, FILES AND FREEDOMS
Your personal data will not be passed on to third parties and will only be used for the management and communication of Elips. You have an individual right of access, rectification and opposition, with Elips under the conditions of the deliberation N° 80-10 of 1/4/2002 of the Commission Nationale Informatique et Libertés.
8. TACIT RENEWAL
The initial rental period is 10 days from receipt of the helmet. This period will be extended by tacit agreement and a new 10-day charge will be made to your account at the end of the 11th day if the helmet has not been returned within the period stipulated in the GTC.
